Big banking lawsuits mushroomed from the 1981 collapse of Western Canada's economy which followed on the heels of Ottawa's announcement of the National Energy Program and Mr. Marshall spent most of his time defending multimillion dollar lender liability and improper receivership court cases launched by corporate borrowers who alleged their businesses had been destroyed by the improper conduct and broken promises of banks. All of these were hard fought lawsuits as were the multimillion dollar commercial banking actions Marshall handled involving the likes of business legends Nelson Skalbania, Peter Thomas (Century 21) and Peter Pocklington, to name a few.

His banking litigation practice provided him the opportunity of working with and learning from the best lawyers in the business. From 1987 until Mr. Majors appointment to the Supreme Court of Canada, Mr. Marshall was co-counsel with Jack Major , one of Canadas top trial lawyers, of Bennett Jones, one of Canada's best law firms, defending Royal Bank of Canada in a series of multi-million dollar lender liability lawsuits. From 1991 until 1998, Marshall defended these cases with co-counsel Cliff O'Brien , another top Canadian trial lawyer, a former Chairman of Bennett Jones LLP and recently appointed to the Court of Appeal of Alberta.
